HyperHog Acceptable Use Policy

Our Acceptable Use Policy is straightforward. We ask you to follow the rules on the Internet and not do anything that would harm our network or someone else's network as a result of your actions. We also ask you to be responsible for the software you use, and for the charges you incur while you are connected. Finally, we agree to work with you to resolve disputes, but if we cannot agree on a solution, our liability is limited to the amount of your current monthly charges. To assume greater liability on our behalf would require us to charge higher rates for our service. These points are outlined in the elements of our Acceptable Use Policy, as defined below. This policy is subject to change without notice.

1.      BCI, Inc. services may only be used for lawful purposes. Transmission or storage of any information, data, or material in violation of any US or state law or regulation is prohibited. The subscriber agrees to indemnify and hold harmless BCI, Inc. from any claims resulting from the subscriber's use of the service that damages either the subscriber or another party or parties.

2.      The subscriber is responsible for following all rules and regulations pertaining to the means by which the subscriber connects their terminal or PC to BCI, Inc., including payment of shareware royalties, if any, directly to authors. Subscriber agrees to abide by any licensing restrictions applying to any software supplied by BCI, Inc.

3.      The subscriber agrees to follow general "netiquette" when sending messages to news groups and email recipients. The subscriber will refrain from advertising in those areas of the Internet that do not expressly allow advertising. "Spamming", and other forms of unwelcome advertising, is strictly prohibited.

4.      Payment for BCI, Inc. services is due upon signup for service, and at monthly intervals thereafter. Monthly service is prorated when you sign up, however if you cancel your account your service will NOT be prorated down. We will simply disconnect your account at the end of the current month.

5.      Payments for service are due on the 1st of each month and considered late as of the 15th of the month. On the 15th, a late fee of $5.00 will be added to your accounts. Accounts are subject to de-activation after the 15th and you will still be responsible for any charges already incurred. Payments not made by the late date of the 15th of each month are considered delinquent and may be subject to reasonable collection and legal fees as well as interest accrued at 1.5% per month, or the state legal limit. Returned checks are subject to a charge of a $25.00 fee for our efforts to collect the returned check.

6.      Subscriber agrees to accept electronic transmission of bills through their BCI, Inc. email account. BCI, Inc., at their option, will send paper invoices when warranted.

7.      Subscriber agrees that BCI, Inc. has the right to delete any and all information stored in the subscriber's account when the account is terminated, for any reason, by either BCI, Inc. or by the customer.

8.      BCI, Inc.’s  personal accounts cannot be used by anyone other than the subscriber. Personal accounts can only send IP packets from or receive IP packets for the assigned IP address. Only one telephone connection may be used at a time. IP addresses are assigned on a dynamic basis.

9.      You may not use your BCI, Inc. account as a dedicated dial up connection to the Internet. You may not use your account to run a remote server (i.e. irc, web). Running a remote server is cause for immediate de-activation of your account. Unlimited Access is defined as access to the Internet while you are actually using the computer while connected to the Internet. You may not connect to the Internet and leave your system running while it is un-attended. Auto dialers and "keep connected" software is strictly forbidden, i.e. leav AOL Instant Messenger or ICQ running does not qualify as being in front of your system using it. You cannot log in and simply leave AOL Instant messenger or ICQ running if you are not in front of the computer using it. There are only so many phone lines and so much bandwidth. We want all of our users to get equal access.

10.  Subscriber certifies that he or she is at least 18 years of age. It is the responsibility of the subscriber to keep BCI, Inc. informed in the event the subscriber's mailing addresses is changed. BCI, Inc. will cooperate with law enforcement authorities if an account is opened under fraudulent pretenses. BCI, Inc. reserves the right to suspend service at any time, for any reason, without advance notice.

LIMITED WARRANTY. No warranty is made by BCI, Inc. regarding any information, services, or products provided through, in connection with, or by BCI, Inc., and BCI, Inc. expressly disclaims any and all warranties, including without limitation: 1) any warranties as to the availability, accuracy, or content of information, products, or services; and 2) any warranties of merchantability or fitness for a particular purpose.

LIMITED LIABILITY. The liability of BCI, Inc., including without limitation any liability for damages caused or allegedly caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use of records, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action, shall be strictly limited to the amount paid by or on behalf of the subscriber to BCI, Inc. for the current month.

Use of a BCI, Inc. account constitutes acceptance of these Terms and Conditions.
